Attorney for Underage DUI Charges in Lake Stevens
Representing Drivers Facing Under 21 DUI Charges
When a young person is arrested for an underage DUI in Lake Stevens, WA, the clock starts immediately. The Department of Licensing opens an administrative hearing window right after arrest, and missing that deadline triggers an automatic license suspension before the criminal case even begins. DUIHeroes handles DUI defense exclusively, and founding attorney Jonathan Dichter is a Qualified Instructor for the NHTSA sobriety-testing course Washington officers use to build these arrests. That technical depth is part of why, on average, 95% of first offenses we’ve handled since 2009 have been reduced or dismissed.* Individual results vary, but that record starts with knowing precisely where these cases may be challenged.
We serve Lake Stevens and all of Snohomish County. Free initial consultations are available, and our phones are answered 24/7 to get you help when you need it. Interpreter services are available in most languages.

Underage DUI: What Lake Stevens Families Need to Know
Washington’s underage DUI statute, RCW 46.61.503, criminalizes driving with a blood alcohol concentration (BAC) of 0.02 or higher for anyone under 21. That threshold is far below the adult standard of 0.08, reflecting the state’s zero-tolerance approach. Even one drink may put a young driver over the limit.
The statute also applies a zero-THC standard for drivers under 21: any detectable THC concentration above 0.00 in the blood can support a charge under the same law. If the driver registers a BAC of 0.08 or higher, the state charges them under the standard adult DUI statute, RCW 46.61.502, which carries mandatory minimum jail time and steeper fines. A charge under RCW 46.61.503 is a misdemeanor; a standard adult DUI is a gross misdemeanor. That distinction affects penalties and future DUI records. Importantly, a minor DUI conviction under RCW 46.61.503 doesn’t count as a prior offense for adult DUI mandatory penalty enhancements if the person faces charges as an adult later.
Consequences of an Underage DUI Conviction in Washington
A conviction under RCW 46.61.503 carries a maximum of 90 days in jail and a $1,000 fine. Unlike adult DUI, there’s no mandatory minimum jail term, but the collateral consequences can be just as serious for a young person in Lake Stevens.
The consequences extend well beyond the courtroom:
- License suspension: Arrest alone triggers a 90-day DOL administrative suspension under Washington’s implied consent law, independent of any conviction
- Second offense or refusal: A second underage DUI, or a second refusal of testing, can extend suspension to two years or until the driver turns 21, whichever is longer
- Additional penalties: Probation, alcohol evaluation and treatment, community service, a DUI victim panel, and a court-ordered ignition interlock device are all possible
- Education and financial aid: Many colleges and scholarship programs have strict criminal record policies that can affect eligibility after a misdemeanor conviction
- Insurance and employment: A conviction raises auto insurance rates and appears in background checks
The DOL Hearing: Why You Must Act Fast After an Arrest
The Department of Licensing administrative hearing runs on a separate track from the criminal case. After an underage DUI arrest in Lake Stevens, a defendant has just 7 days from the date of arrest to request that hearing. As stated on the Washington DOL’s own hearing request form, the request must be postmarked within 7 days of the arrest. Miss that window and the 90-day suspension goes into effect automatically, regardless of what happens in court.
Winning or losing the DOL hearing doesn’t determine the criminal outcome, and vice versa. A restricted or hardship license for essential activities such as school or work may also be available, depending on eligibility. Acting within 7 days of the arrest, not weeks, can make the difference between preserving options and losing them.
Defense Strategies for Lake Stevens Underage DUI Cases
A 0.02 BAC reading is near the margin of error for many breath-testing devices. That’s just one reason these cases are worth fighting. At DUIHeroes, we investigate every case for the procedural and technical vulnerabilities that may give us leverage.
Jonathan Dichter completed the NHTSA Standardized Field Sobriety Testing (SFST) student course, and he is a Qualified Instructor who has taught that course to lawyers, judges, and investigators. Every attorney on our team has completed the same training. That means we evaluate field sobriety test administration the same way the officers were trained, and we know exactly where the process may break down.
Common defense angles in underage DUI cases include:
- Field sobriety test validity: Tests administered on uneven pavement, in poor lighting, or under adverse weather conditions may produce unreliable results that can be challenged
- Breathalyzer accuracy: Device calibration records, maintenance history, and mouth alcohol interference can all undermine a BAC reading
- Lawfulness of the stop: If law enforcement lacked reasonable suspicion or probable cause for the initial stop, evidence gathered afterward may be suppressed
- Blood test integrity: Improper sample handling, chain of custody errors, or timing issues relative to the two-hour window in RCW 46.61.503 can call results into question
Depending on the arresting agency, a Lake Stevens underage DUI case may be heard at Marysville Municipal Court (for arrests by Lake Stevens Police) or at Snohomish County District Court Evergreen Division in Monroe (for arrests by the Snohomish County Sheriff or Washington State Patrol). We practice in both courts and know how each approaches these charges.
