Drug DUI Defense in Lake Stevens
Lake Stevens DUID Defense Backed by 50+ Years of Experience
A drug DUI charge in Lake Stevens, WA, carries the same criminal consequences as an alcohol DUI and moves through Snohomish County on the same tight timeline. At DUIHeroes, we handle DUI defense and nothing else. Our team brings over 50 years of combined legal experience, two former prosecutors, and a founding attorney who doesn’t just understand how officers conduct drug impairment evaluations; he's a qualified instructor in the same NHTSA/IACP course Washington officers complete.
Since 2009, we’ve achieved an average 95% rate of reduction or dismissal for first-offense DUI charges.* Free initial consultations are available, and our phones are answered 24/7.
If you’ve been arrested for a drug DUI in Lake Stevens, call DUIHeroes now at (425) 296-9358 to speak directly with our team.
What Counts as a Drug DUI Under Washington Law
Washington’s DUI statute, RCW 46.61.502, covers far more than illegal drugs. It criminalizes driving while under the influence of or affected by cannabis, prescription medications, and over-the-counter drugs. That scope surprises many people who assumed a valid prescription protected them. Under RCW 46.61.502(2), it doesn’t.
For cannabis specifically, prosecutors can charge a per se violation if a blood test drawn within two hours of driving shows 5.00 nanograms of THC per milliliter. Below that threshold, the “affected by” prong still applies: if the state can show driving ability was impaired, a charge can proceed regardless of measured levels.
The penalties for a first-offense gross misdemeanor DUID conviction are serious:
- Jail: Mandatory minimum of 24 hours, up to 364 days
- Fines: Minimum $990.50, up to $5,000
- License suspension: 90 days minimum for a first offense
- Mandatory education: Drug or DUI education program required
Three or more prior DUI-related offenses within 15 years can elevate the charge to a felony under Washington law.
Why Drug DUI Cases Are More Contestable Than You Might Expect
Unlike alcohol DUI, a drug DUI case in Lake Stevens typically has no breath test. Prosecutors build their case on officer observations, Drug Recognition Expert (DRE) evaluations, and blood toxicology results. Each of those elements carries real vulnerabilities.
DRE evaluations rely on the officer’s subjective read of physical signs: pupil size, pulse rate, muscle tone, and behavioral cues. Fatigue, anxiety, illness, dehydration, and certain medical conditions can produce the same signs officers associate with impairment. An evaluator working from assumptions or skipping procedural steps compromises the entire analysis.
Blood test results deserve the same scrutiny. For a toxicology result to hold up, the collection timing, storage, chain of custody, labeling, and laboratory procedures must all meet strict standards. A break anywhere in that chain can undermine the reliability of the findings. THC also metabolizes differently from alcohol: blood levels can remain measurable well after any actual impairment has passed, which means a positive test is a starting point for defense work, not a conclusion.
How We Defend DUID Charges in Lake Stevens
Our approach to drug DUI defense is built on credentials that matter in these cases. Every attorney at DUIHeroes has completed the same NHTSA Standardized Field Sobriety Testing (SFST) course that Washington law enforcement officers complete. Founding attorney Jonathan Dichter goes further: he is a Qualified Instructor for the NHTSA/IACP DWI Detection and SFST course. He also completed the Advanced Roadside Impairment Driver Enforcement (ARIDE) course. When we examine how a DRE evaluation was conducted, we’re reading it from the inside.
We also have two former prosecutors on our team. They know how the state evaluates a drug DUI case and what it takes for a charge to hold up in Snohomish County court. That prosecutorial knowledge shapes how we build the defense from day one.
Defense strategies we examine in drug DUI cases may include:
- Traffic stop validity: Whether the officer had lawful justification to initiate the stop
- DRE evaluation integrity: The officer’s qualifications, procedural compliance, and whether observations were fairly documented
- Blood test chain of custody: Collection timing, storage conditions, labeling accuracy, and laboratory protocols
- Alternative explanations: Medical conditions, prescription medications, or other factors that account for the observed signs
- Impairment vs. presence: Whether the state can prove actual impairment, not just a detectable substance in the blood
We intentionally limit our caseload so clients get direct, detailed attention from their attorney. A secure client portal keeps you updated in real time with direct messaging to your legal team.
